PERSONS PROSECUTED UNDER PREVENTION OF MONEY LAUNDERING ACT
508. SHRI DEREK O’ BRIEN:
Will the Minister of EXTERNAL AFFAIRS be pleased to state:
(a) the details of the persons who have been prosecuted under the Prevention of Money Laundering Act and have absconded;
(b) whether the Ministry has received any communication from the Ministry of Home Affairs regarding the same; and
(c) whether the Ministry is in talks with the United Kingdom to bring back persons under investigation as per the 1992 India-UK Mutual Legal Assistance Treaty, if so, the details thereof, and if not, the reasons therefor ?
ANSWER

(a) As per information received from the Directorate of Enforcement, New Delhi, the prosecution complaint has been filed against 53 persons, who are absconding, under the Prevention of Money Laundering Act, 2002. The list is attached as
Annexure-A.
(b) The Ministry of External Affairs has not received any request from the Directorate of Enforcement, New Delhi or from the Ministry of Home Affairs for extradition of persons mentioned in the list in connection with cases under Prevention of Money Laundering
Act, 2002.
(c) The Ministry of Home Affairs, the nodal Ministry for Mutual Legal Assistance Treaty (MLAT) in Criminal Matters, has conveyed that the India-UK MLAT in criminal matters does not cover the subject to bring back persons under investigation. However, the CBI
had submitted extradition request in respect of Mr. Vijay Mallya regarding the case under Indian Penal Code, 1860 and Prevention of Corruption Act, 1988 for his extradition from UK. The extradition request has been sent to UK for their consideration under
bilateral extradition treaty.
